Building Claims Evaluations Ltd

The insurance litigation market requires additional architectural and construction expertise to advise it in evaluating and responding to leaky building claims. Building Claims Evaluations Ltd (BCE) has been formed to respond to this market need. It is available to insurers and lawyers to evaluate the technical aspects of any building claims made by third parties. BCE's focus is on providing targeted expertise in litigation support in responding to claims made against insured parties.

The BCE team is led by Daniel Djain (Ms Arch) and supported by City and Guilds qualified registered builders and estimators, Lindsay Clapham and Richie Clapham.

What Will BCE Do?

While every brief is individually evaluated, BCE can attend to any or all of the following:

• Provide a scoping report from which a detailed brief can be prepared and agreed to ensure only targeted necessary work is undertaken.
• Evaluate and comment on specific or general allegations re causation relevant to alleged building or design defects claimed to have resulted in building defects and/or physical damage
• Investigate the circumstances and establish the chronology of events
• Prepare document trails
• Evaluate document trails
• Establish contractual chains, obtain and evaluate contract documents relevant to the design and workmanship requirements
• Evaluate plans, consents (Resource & Building) and TA submissions and the processes surrounding each
• Evaluate (or create) a scope of works and specification for remedial works, separating elements of remedial works by cause of damage - including evaluation of overlapping causes
• Evaluate (or prepare) estimated costs for remedial works
• Evaluate / quantify improvements and betterment
• Monitor reinstatement or remedial works as required
• Provide litigation/mediation support, full reporting and expert evidence on the above as required
• Identify other potentially liable or contributing parties, including other insurers
• Attend any mediation or trial to provide evidence

The Team

Daniel A. Djain  Ms Arch

Daniel is an Architect with over 30 years of International experience in the corporate world at Board and Senior levels, in retail and other sectors.

He has worked as a Senior Architect in South America and Great Britain developing shopping centres, department stores, high street retailing, office and hotel design and construction.

Lindsay Clapham

Lindsay is an EQC Certified Estimator and Registered Builder and brings in excess of 30 years building experience to the team. His experience includes City and Guilds qualified in advanced carpentry and estimating and operating his own successful residential construction company.

Richie Clapham

Richie is an EQC Certified Estimator and Registered Builder having been involved with the building industry since the mid 1990's. His experience includes City and Guilds qualified in advanced carpentry and estimating and operating his own successful residential construction company.
